1. Services

Sybabee provides repair and maintenance services for commercial and residential properties throughout Canada. These services include but are not limited to commercial repairs, residential repairs, emergency repairs, renovations, and preventive maintenance as described on our Website.

Service availability may vary by location. All services are subject to availability and Sybabee reserves the right to refuse service to anyone for any reason at any time.

2. Service Agreements and Quotes

For certain services, Sybabee may provide quotes or estimates prior to beginning work. All quotes are valid for 30 days from the date of issuance, unless otherwise specified. Quotes are based on information provided by the client and visual inspections where applicable. Additional charges may apply if:

• The scope of work changes after the quote is issued
• Additional problems are discovered during the repair process
• Information provided by the client was inaccurate or incomplete
• Access to the work area is restricted or delayed

Any changes to the quoted price will be communicated to you before additional work is performed.

3. Payment and Billing

Payment terms are as follows:

• For small repairs (under $1,000), payment is due upon completion of the service
• For larger projects, a deposit of 25-50% may be required before work begins, with the balance due upon completion
• For ongoing maintenance agreements, payment schedules will be specified in the service contract

We accept various payment methods, including credit cards, e-transfers, and checks. Late payments may be subject to a fee of 1.5% per month on the outstanding balance.

4. Cancellations and Rescheduling

If you need to cancel or reschedule a service appointment, please notify us at least 24 hours in advance. For cancellations with less than 24 hours' notice, a cancellation fee of $75 may apply.

For project cancellations after materials have been ordered or work has begun, you may be responsible for costs incurred up to the point of cancellation, including labor, materials, and restocking fees.

5. Warranties

Sybabee provides the following warranties on our services:

• Workmanship: 1-year warranty on labor for most repairs
• Materials: Manufacturer warranties pass through to the client
• Renovations: Extended warranties may apply as specified in your service agreement

These warranties do not cover damage due to:

• Normal wear and tear
• Improper use or maintenance
• Alterations by anyone other than Sybabee
• Acts of nature (floods, fires, etc.)
• Damage caused by third parties

6. Website Use and Content

6.1 Website License

Subject to these Terms, Sybabee grants you a non-exclusive, non-transferable, revocable license to access and use the Website for personal, non-commercial purposes.

• Use the Website in any way that violates any applicable federal, provincial, local, or international law or regulation
• Use the Website to transmit or send unsolicited commercial communications
• Access, tamper with, or use non-public areas of the Website, Sybabee's computer systems, or the technical delivery systems of Sybabee's providers

The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Sybabee, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website without the prior written consent of Sybabee.

6.4 User Contributions

The Website may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards, and other interactive features that allow users to post, submit, publish, display, or transmit content or materials. All User Contributions must comply with the Content Standards set out in these Terms.

Any User Contribution you post to the site will be considered non-confidential and non-proprietary. By providing any User Contribution on the Website, you grant us and our licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material.

For repair services, Sybabee's liability is limited to the amount paid for the specific service giving rise to the claim. Sybabee is not responsible for indirect or consequential damages resulting from our services.

8. Indemnification

You agree to defend, indemnify, and hold harmless Sybabee, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Website or Services.

9. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the courts of the Province of Ontario, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant jurisdiction.

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Website thereafter.
